The applicant, Gavin Tierney, alleges that he was assaulted by arresting Gardaí during his detention. After initially filing a complaint, Tierney saw his allegations dismissed by the Garda Ombudsman Commission. This dismissal was later revisited following contradictions in witness testimonies during a District Court hearing.
