HE FORMER chief legal officer of the Criminal Assets Bureau and two former high-ranking gardai are being sued in a €25.6m legal action in the US.

The case centres on their alleged role in the freezing of the assets of a US scientist by the government of the tiny African republic of Seychelles.

The case, which was lodged in New York earlier this week, has cast light on the role of gardai appointed by the Republic of Seychelles to combat corruption and money laundering in the tiny offshore financial centre off the east coast of Africa.

Cork solicitor Barry Galvin, who was appointed by the Seychelles government to conduct a review of its criminal justice system, has been cited in the civil action by an American citizen who claims that the Republic of Seychelles illegally froze €5.65m deposited in the Seychelles branch of Barclays Bank from his solar energy company last year.

Recently retired gardai Liam Hogan and Declan Barber are also being personally sued by scientist Dr George Xiao over the disputed asset freeze action by the Seychelles government.

It is alleged that the three men worked as sub-contractors for the Seychelles government's Financial Intelligence Unit which froze Dr Xiao's account with Barclays.

Earlier this year, four former Irish police officers including Mr Hogan were appointed by Seychelles President James Michel to support the island's acting commissioner of police to "build public confidence in the Seychelles Police Force".

Mr Hogan, a former garda superintendent, is an intelligence expert and deputy director of the Seychelles Financial Intelligence Unit (FIU) which has CAB-style powers to freeze and seize assets.

Mr Barber, the Seychelles honorary consul in Ireland who is described in court pleadings as the director of the FIU, is also cited in the action as one of the "Irish sub-contractors". A 99-page complaint, filed in the US District Court Southern District of New York and obtained by the Irish Independent, claims that the Seychelles government sub-contracted its FIU operations to Mr Galvin, Mr Barber and Mr Hogan.

Last night, Dr Xiao's lawyer, Craig Weiner, said his client's funds were seized without any "viable justification". Mr Weiner said that the transaction that triggered the Xiao/FIU investigation was perfectly legitimate.

Mr Galvin, who last night told the Irish Independent that he had yet to receive notice of the New York action, travels to the Republic of Seychelles on a regular basis in his capacity as a private consultant to its government.

Mr Hogan is currently in the Seychelles and Mr Barber did not return calls by the Irish Independent.

Complaint Alleges Over 100 Cases of Seychelles’ Seizure of Funds Without Justification, While Accepting IMF Loans and Help from The African Development Bank and Devastating the Nation’s Offshore Banking Industry

NEW YORK--(BUSINESS WIRE)--Two Companies, Cooperhill Investments Limited and Kazou BV, recently filed a lawsuit in the United States District Court for the Southern District of New York seeking to recover $10.8 million that the companies allege the Republic of Seychelles illegally seized from them in 2010. As alleged in the complaint, this seizure is the latest in a campaign of financial piracy by the Republic of Seychelles, which has seized over 100 bank accounts of foreign individuals and companies since 2008. Following a consistent pattern of behavior that has been exposed in two previous lawsuits alleging financial piracy, the Seychelles’ Financial Intelligence Unit (FIU), who took the money, has offered no explanation at all for its seizure of the assets. One of these prior lawsuits, according to the Complaint, alleged that Seychelles even kidnapped foreign nationals, threatened them with false drug charges and harassed a teenage girl to meet its goal of stealing money from the plaintiffs in that case.

The Complaint alleges that this program of state-sponsored financial piracy is being undertaken by the Republic of Seychelles in order to rebuild its foreign reserves as the result of an acute financial crisis stemming to 2008. Furthermore, as the Complaint pleads, Seychelles is obtaining financial assistance from both the International Monetary Fund (IMF) and the African Development Bank, while, at the same time, stealing money from Seychelles’ banking customers. This conduct, the Complaint alleges, is consistent with findings of the U.S. State Department that Seychelles officials sometimes engaged in corrupt practices with impunity.

As alleged in the Complaint, in this most recent example of financial piracy, a BMI Bank manager lured Cooperhill’s patronage from another bank and then helped the FIU illegally take Cooperhill’s funds. The Complaint also alleges that BMI Bank then helped the FIU actually increase the amount of money in the account by surreptitiously blocking withdrawals while at the same time allowing numerous further deposits. The Complaint further alleges that Barclays Bank, as it has done in the past, conspired with the FIU to illegally seize Kazou’s funds. To accomplish this goal, the Complaint alleges, Barclays Bank stalled and asked unnecessary questions in order to prevent funds from transferring out of the account. The net effect, according to the Complaint, was that Barclays helped the FIU to grow the funds that it stole.

Craig Weiner, Esq. of Hofheimer, Gartlir, Gross, LLP, a New York based law firm and lead counsel for the plaintiffs stated: “Few people would believe that in this day and age that their bank assets could be seized by a foreign government without regard to due process of law, banking regulation, or standard business practice. Our complaint alleges that this very condition has existed since at least 2008 in the Seychelles, and we strongly advise investors to be wary of depositing any assets there for that very reason."

The Complaint also pleads that the FIU carried out their illegal actions at the direction of Irish nationals Barry Galvin, Liam Hogan, Declan Barber and Joe Cully (aka Niall Scully), who act as subcontractors to Seychelles, and each have been individually named in prior lawsuit(s) and in this recent Complaint. According to the complaint, Galvin and Hogan are former members of the Irish national police force and secret police and Barber and Cully were members of a secret Irish military unit. According to the Complaint, these rogue subcontractors reportedly receive substantial commissions based on the amount of funds they seize and are compensated far in excess of their Seychelles counterparts, which according to the Seychelles press has resulted in significant discord.

The Complaint alleges that the Seychelles government has continued its policy of financial piracy, even in the face of heightened scrutiny from the prior lawsuits and media attention. This time, as alleged in the Complaint, Seychelles has not even bothered to offer an excuse for why its agents have stolen the funds -- it merely took the money.

Lawsuit Charges Seychelles Government With Financial Piracy

Complaint Charges that Government Illegally Seized $8.5 Million from Solar Energy Company With Help From Barclays Bank and Three Irish Subcontractors 

(December 1, 2009, New York, NY) – Dr. George Xiao today filed a lawsuit in the United States District Court for the Southern District of New York seeking to recover $8.5 million that he alleges the Republic of Seychelles illegally seized from his solar energy company in 2008. The complaint also seeks over $30 million in consequential damages. The Seychelles Government has offered no credible explanation or formal justification for its seizure of the assets deposited in the Barclays Bank branch in Seychelles and refuses to return the money.

As set forth in the complaint, Seychelles embarked upon a course of action wherein it seized the funds without cause and only afterwards sought to “work backwards” and create a viable justification for the seizure. However, no justification exists. In the past year the Government of Seychelles has seized more than 100 bank accounts held by foreign individuals and companies. 

Seychelles has been in an acute financial crisis since 2008. The International Monetary Fund has had to step in to save the country from the brink of disaster. Seychelles is also trying to renegotiate its foreign debt, and its foreign exchange reserves are depleted. Adding to its other financial woes Seychelles has recently been tied to the $10 billion Kazakh Bank scandal.

“Our complaint alleges that the Seychelles government is so desperate for money that it has resorted to what amounts to financial piracy, preying on unsuspecting foreign businesses and individuals,” said Craig Weiner, an attorney at Hofheimer Gartlir & Gross, LLP, which represents Dr. Xiao and his company. “Seychelles is using unfounded and unproven allegations of fraud and money laundering as a pretext to seize the bank accounts of non-citizens with no legal or logical justification,” Weiner added, summarizing the allegations made in the complaint.

“Seychelles positions itself as an offshore financial center in order to lure unsuspecting businesses and then misappropriate their funds,” Weiner added, describing the complaint. “Even the U.S. State Department has warned that Seychelles officials often engage in corruption with impunity. If you are thinking of doing business in Seychelles, beware,” Weiner added.

The complaint also alleges that the Seychelles Financial Intelligence Unit (FIU) has subcontracted its operations to three Irish nationals, Barry Galvin, Liam Hogan, and Declan Barber, each of whom is named individually as a defendant. According to the complaint, Galvin and Hogan are former members of the Irish national police force and secret police. According to the complaint, these rogue subcontractors have no background in banking or financial matters and reportedly receive substantial commissions based on the amount of funds they seize.

The complaint further alleges that Hogan and Barber have committed perjury and have brazenly and routinely ignored court orders. “Anyone who has been convicted of a crime in Ireland on the strength of their testimony should consider petitioning the court for a new trial,” Weiner said.

In December 2008, Dr. Xiao sought to establish a bank account for his company at Barclays Bank in Seychelles in order to receive wire transfers from a client in Asia. According to the complaint filed today, Barclays repeatedly delayed opening the account and failed to provide the necessary account documents and information. It turned out that at the same time, Barclays was working with the FIU to plan the seizure of the funds.

When the account was finally opened, Barclays and Seychelles officials immediately seized the assets. Neither Barclays nor the FIU has ever provided Dr. Xiao with a copy of FIU’s formal justification for seizing the company’s assets. The complaint also alleges that Barclays and Seychelles officials in 2009 engaged in a fraudulent scheme to seize additional deposits made by Dr. Xiao’s company.

An article in a local Seychelles newspaper severely criticized both Barclays and the Seychelles government for what it called “incompetence, a lack of understanding of normal banking procedures and protocol, and extreme arrogance and impunity in the application of the law.”

DPP and Gardai hiding vital & very important evidence again, that could cost the state another lawsuit for breaching people's rights to know

The Ditch can reveal that a county Westmeath man pleaded guilty this month to possession of a shotgun last year that should’ve been in garda custody. 

Gardaí previously seized the gun in 2009 before it went missing. 

The DPP and An Garda Síochána won’t say if and when they informed the man’s legal team that the shotgun should have been with gardaí since it had been seized. 

‘It was recorded as being in their possession’ 

On August 9, 2023, 54-year-old John Nevin and his 32-year-old son David Nevin were arrested after allegedly failing to stop their car for gardaí. 

The Nevins, both from Mullingar in county Westmeath, appeared before a special sitting of Longford District Court the following day.  

Here it was further alleged during the chase in Mullingar that ended on foot, the men discarded a shotgun and cartridges in a plastic bag that was recovered by gardaí at the scene.

Gardaí discovered two days after the firearm’s seizure that it was recorded as being in their custody since 2009 after being seized during a raid on a property in Leinster.

The DPP and An Garda Síochána declined to comment when asked by The Ditch if and when they had notified the Nevins’ solicitor of this development. 

An internal investigation is underway into the disappearance of the firearm from garda custody, as reported by the Irish Times. 

On 9 April this year, John Nevin pleaded guilty to possession of the shotgun when he was arraigned before Mullingar Circuit Criminal Court. 

Nevin was remanded on bail pending the preparation of a probation report and is due to appear before the court again in June for a pre-sentence mitigation plea.

Physio allegedly sexually assaulted female colleague and stalked her over several months, NOT PROSECUTED BY DPP SOLICITORS?

The inquiry heard that the DPP had directed that no prosecution should arise from the incident after it was reported to gardaí.

A physiotherapist at a HSE centre in Tipperary allegedly sexually assaulted a female colleague and engaged in sexual harassment and stalking of her over several months, a fitness-to-practise inquiry has heard.

A clinical psychologist claimed the physio, Sarath Divakaran, sexually assaulted her at a hotel in Clonmel on May 27, 2019, when he placed his hand on her pubic area while sitting beside her at a conference.

The inquiry heard that the DPP had directed that no prosecution should arise from the incident after it was reported to gardaí.

The psychologist – who was identified only as Miss A – broke down crying several times while giving evidence over Mr Divakaran’s “taunting, intimidating and menacing” behaviour.

She described how she ended up carrying a “rape whistle” and a flashlight with a strobe effect for protection at her job.

The inquiry heard that Miss A first began to feel “unsafe at work” due to the unwanted attention of the physio who made repeated comments about her appearance and posture, including a suggestion that she should stand in front of a mirror naked.

She described feeling very uncomfortable after being informed by Mr Divakaran that he had been watching her movements where they worked at South Tipperary Therapeutic Services in Clonmel, Co Tipperary.

Mr Divakaran is facing a total of 18 allegations of professional misconduct before a fitness-to-practise inquiry being held by CORU – the regulatory body of health and social care professionals.

The allegations relate to claims of inappropriate behaviour and failing to maintain professional boundaries in his interactions with two female psychologists working at STTS between 2019 and 2022.

Mr Divakaran, a native of India who has worked in Ireland since 2003, claims his behaviour towards the two women has been “misinterpreted and gravely misunderstood”.

While the physio, whose wife also worked at STTS at the same time, accepts that he had sometimes crossed professional boundaries, he denied engaging in any harassment or conduct of a sexual nature with his work colleagues.

On the second day of the inquiry on Thursday, Miss A described how she started receiving “unannounced and uninvited” visits to her office from Mr Divakaran shortly after she began working at STSS in January 2019.

Miss A said the visits which increased in frequency over time had “no professional purposes”.

She told CORU’s fitness-to-practise committee that she declined all Mr Divakaran’s invitations to go for a coffee or a walk.

“Suddenly I felt unnerved because he was watching me,” Miss A observed after the physio told her that he had been “studying” her movements.

She outlined how she had to restrict where she went at STSS in order to feel safe.

Miss A said his comments about standing naked in front of a mirror and inviting her to a physio room “to check my tone” demonstrated he wanted to physically touch her.

She claimed such remarks were “unsolicited and unethical” and left her feeling humiliated.

On another occasion the physio told her that she “rubs well” which Miss A came to understand was a reference to masturbation.

At a conference on May 27, 2019, Miss A said Mr Divakaran gave her a portrait that he had drawn of her which she declined as it made her feel “very uncomfortable and violated”.

On the same day, she claimed she was sexually assaulted by the physio when he touched her on her groin with the back of his upturned palm as he gave her back a leaflet that he had picked off her seat.

“I froze. I felt really confused. I felt frightened,” she told CORU counsel, Neasa Bird BL. “I was in complete disbelief.”

Miss A said she did not report the incident to anyone at the time because she felt so humiliated and also because of the “power dynamics” of a situation involving an experienced senior physio.

The inquiry heard that Miss A discovered later that summer that Mr Divakaran had also engaged in a pattern of sexual harassment and stalking of another female worker at STSS (known as Miss B).

Asked if she was unhappy with how HSE management had dealt with the issue, she replied that she had received “conflicting advice”.

Miss A said she became very frightened again after Mr Divakaran started parking his car near her vehicle and walking on her corridor again in December 2020.

The inquiry heard he also tried twice to interact with her the following month when he wished her a “Happy New Year” and held a door open for her.

Miss A said she reported both incidents to management straight away.

“I knew I was very unsafe around this man,” she added.

The witness said the physio had shown no remorse for his actions and had demonstrated no insight into the impact of his behaviour.

The inquiry heard Miss A relocated to an office in Cashel where she still felt unsafe before eventually resigning from her job after taking time off work with post-traumatic stress disorder symptoms because of Mr Divakaran’s behaviour.

She fought back tears as she explained his actions had affected her career as she had to “walk away from a job I loved” and give up promotional opportunities because she was concerned for her physical and mental health.

Asked about the physio’s claims that his actions had been misinterpreted, she replied that they “demonstrate what a real danger and threat he is to women”.

Under cross-examination by counsel, Elaine Finneran BL, Miss A rejected various explanations offered by Mr Divakaran over how his behaviour had been misunderstood.

She reported the matter to HSE management as she had grave concerns for the safety of female staff at the Clonmel facility because of the physio’s behaviour.

The inquiry heard that a decision was taken to deal with the matter informally through the implementation of a safety plan at the end of 2019 which included instructions to Mr Divakaran not to park near the cars of his two colleagues or to walk near their offices.

Ms Finneran said the physio had only been trying to be friendly towards her as a new employee such as recommending the canteen as a good place to meet colleagues.

However, Miss A said such a suggestion was “frankly insulting”.

She claimed his comments about her gait and posture were part of “a repeated pattern of behaviour and a formula for grooming people” rather than the concern of a physio.

Ms Finneran said her client apologised for attempting to compliment his colleague on her clothing and make-up which he realised in hindsight was inappropriate.

The barrister said Mr Divakaran’s quick “caricature” of Miss A was meant as a joke but which he now accepted was inappropriate.

The inquiry heard earlier in the week similar evidence from Miss B who described being “terrified” and “scared” by the physio’s unwanted physical touching and comments of a sexual nature.

Both women confirmed that they are taking legal actions against both Mr Divakaran and the HSE.

The inquiry was adjourned until next Tuesday when it is expected to conclude.

However, Miss A retorted: “I didn’t find it funny. I found it traumatic.”
