Money taken into evidence by gardaí went missing from stations on more than a dozen occasions over a three-year period.*

Between January 1st, 2015, and December 31st, 2017, 14 sums of money confiscated by gardaí as part of investigations disappeared from the evidence storage facilities of stations around the country.

Gardaí declined to release further details about the missing money, citing ongoing investigations. However, it is understood some of the missing sums came to light following internal audits.

Others were noticed when robbery and theft victims applied for the return of their stolen money after the completion of an investigation.

Most of the missing money was being stored pending court cases where it was to be used in evidence against a suspect. In such cases money cannot be lodged in a bank and must be stored securely in the Garda station to preserve the chain of evidence.

Details of the incidents were released to Labour justice spokesman Seán Sherlock last week after he asked the Department of Justice questions about confiscated money found to be "missing, stolen or lost" from Garda stations during the previous two years.

"I am now advised by the Garda authorities that there were 14 incidents between the 1 January 1st, 2015, and 31 December, 2017, where sums of money, confiscated money or evidence in a case were found to be missing or lost from a Garda station," Minister for Justice Charlie Flanagan wrote.

“However due to ongoing investigations the Garda authorities have advised that they are not in a position to identify individual Garda stations.”

Suspect arrested

Last year, a man was arrested in relation to the theft of €12,000 from Kevin Street Garda station. The money, part of which had been confiscated from the Kinahan crime gang, went missing from a secure area of the station. The chief suspect was later released without charge.

“We look forward to the outcome of the investigations and hope they will become a matter of public record,” Mr Sherlock said on Friday.

He also expressed frustration at how long it took the gardaí to return an answer to his parliamentary question (PQ) which was submitted in October 2017.

“I submitted this PQ a year ago. It would be good if there was a clear impetus within the Gardaí to respond in a more timely fashion to members of the Dáil.”

A Garda spokesman told The Irish Times new bar-coding technology known as PEMS2 is being introduced to prevent money and other evidence going missing.

“As part of An Garda Síochána’s Modernisation and Renewal Programme 2016-2021, the PEMS (Property Exhibit Management System) and, in 2018, the PEMS2 system was developed to address some issues and deficiencies that arose in object management.

"PEMS will provide transparency, accuracy and greater efficiency in the management of objects in the custody of An Garda Síochána. PEMS2 will integrate with Pulse and supporting devices which facilitate the efficient transfer of objects in real time within the organisation from member to member, by the use of bar-coding on all objects." A serving Garda who's also a former member of the Louth county football team has pleaded guilty to stealing over €1,100 from a local Garda station.

James Murray, with an address at Ashbourne Garda Station, admitted the theft of seven postal orders worth €1,120 at that station on various dates between March 2019 and November 2020.

The 36-year-old had cashed postal orders that were paid into the station by members of the public whose vehicles had been seized and were being released to them.

Trim District Court was also told the matter had come to light following an internal audit and that the accused - who has repaid the money, was under suspension from the force.

Judge Cormac Dunne took into account that defendant had not made any attempt to cover up his tracks and appeared to have "freed himself" from a serious gambling addiction.

He directed him to pay €3,000 to the Meath Community Drug and Alcohol Response by next Tuesday, when it's expected the charges will be struck out.

The Garda Ombudsman prosecuted a garda for allegedly giving them false information about a disputed conversation in relation to the investigation of his brother for an alleged assault in Shannon in 2019.

Judge Marian O’Leary dismissed the charge against Garda Peter Russell from Shannon, County Clare, after a hearing at Cork District Court.

Judge O’Leary referred to the Ombudsman’s own evidence in prosecution of the case when she dismissed the single charge against Garda Russell. It had been alleged that Garda Russell spoke to Garda Maeve Heelan about the case when he called to her at Ennis garda station. 

Garda Heelan was investigating a complaint against two men including Garda Peter Russell’s brother, Shane Russell, in relation to an assault in Shannon town in February 2019. Judge O’Leary said: “Garda Heelan testified that they did not speak about the incident. She told him she could not discuss the case.

“On the basis of what is before the court I am dismissing the case.” Garda Russell was based in Galway at the time of the count which has now been dismissed.

But the deadly weapon was quickly found to have been one stolen from a gun-dealer in 2004 and then seized by gardaí in a search in 2009.

Records “showed that it was supposed to be still in possession of gardaí in the east of the country”, according to the Garda Press Office.

“This firearm had originally been stolen in a burglary in 2004 and was recovered by gardaí during a search of a premises under warrant in the east of the country in 2009.”

“Within a week of the firearm being seized, a criminal investigation was instigated into how the firearm left the control of An Garda Síochána and came into the possession of the individuals charged with firearms offences.”

Garda Commissioner Drew Harris has given a report on the affair to the Minister for Justice Helen McEntee and to the Policing Authority.

“There has been significant recent public comment, including by Commissioner Harris, on the critical importance of the proper control and recording of evidential material in An Garda Síochána’s possession.”

It was added Commissioner Harris will keep the Minister and the Policing Authority informed of matters as they arise.

The gun should have still been in secure garda storage as its theft in 2004, and its seizure in 2009, remained under investigation, according to the Irish Times which first reported the story.

A garda has told a court how she "didn't feel right" making a "false" record after her sergeant colleague allegedly assaulted a suspect who was in custody.

Waterford District Court heard details of a dispute between gardaí over claims that a Garda sergeant pressured a junior colleague to make a "false entry" on Waterford Garda Station's custody register, following an alleged altercation involving the sergeant and a suspect.

Garda Rachel Pratt told the district court on Friday that it "didn't feel right" when she allegedly neglected to record the incident involving the senior officer, who was also her supervisor at the time.

Garda Pratt alleged that Sgt William Doyle told her not to "mention" an incident in the fingerprinting room in which he allegedly assaulted the suspect at the station in Ballybricken, Waterford city.

Garda Pratt said she was told to record that the suspect, a man in his 20s who had been arrested earlier that morning, had become "aggressive" and Sgt Doyle had tried to restrain him.

The court also heard evidence from two other gardaí, one who claimed that after Sgt Doyle and the man in custody had exchanged "snide remarks" inside the room, the sergeant told the guards — "give me two secs there lads".

Both gardaí told the court they stepped outside the room, but went back in shortly after hearing the sound of "furniture moving" and "pushing" followed by shouts from the suspect accusing the sergeant of assault.

Sgt Doyle accused of two charges

Prosecuting barrister David Perry told Judge John O'Leary that Sgt William Doyle is accused of two charges.

One is a Section 2 assault against the man in custody, under the Non-Fatal Offences Against the Person Act, and one of attempting to pervert the course of justice by allegedly requesting no record be taken.

On foot of an investigation by the Garda Síochána Ombudsman Commission (Gsoc) and a prosecution by the Director of Public Prosecutions (DPP), it is alleged that Sgt Doyle assaulted a suspect in Waterford Garda Station on March 9, 2022.

Sgt Doyle is fully contesting all charges.

Evidence was given to the court relating to the two alleged incidents.

Garda Pratt was the member in charge for the station and its prisoners from 7am on the day when she said she heard a "commotion" and went to a nearby room.

She allegedly witnessed her supervisor, Sgt Doyle, "pinning" the man against the window of the AFIS [automated fingerprint identification system] where suspects have their fingerprints taken.

Garda Pratt told the court she was a probation garda at the time after graduating 14 months earlier.

Man in custody alleged assault had occurred

She told the court that as she and the man in custody left the room, she heard the sound of a 'slap' behind her. 

She said she wasn't sure what had caused the sound but heard the man in custody allege that it had been Sgt Doyle assaulting him.

Garda Pratt said the man moved to the custody area down the hall, where she claims another incident took place.

Garda Pratt told the court that Sgt Doyle had pushed the man "using his chest". 

Both men were shouting at each other. 

She recalled seeing the sergeant "make a fist with his right hand and swing for the man". 

She did not know if he made contact as there was a wall obstructing her view.

"I was taken back by the whole thing," she said. 

I then went into Sgt Doyle, in the sergeant's office as he was my supervisor at the time, to try and figure out what had happened. 

"I then asked, I suppose 'what do I do', but how do I carry on from this, as in from the altercation that's after happening, and what I'm after witnessing," she said

She claims Sgt Doyle said not to mention what happened in the AFIS room.

She said Sgt Doyle told her to maintain he was walking past the custody area when the man "became aggressive and he [Doyle] entered the custody area to restrain him".

This information was entered into the station's custody record register by Garda Pratt at 11.05am.

"I didn't feel right doing it, but I did it," she said.

She later told Gsoc that she was in shock following the incident and had "doubt" in her mind as she made the first entry.

Her statement was read out in court.

"I didn't really know what to do," she told the Ombudsman.

Sgt Doyle's barrister David Staunton said the senior garda never made a request to Garda Pratt to alter the entry into the custody record.

Mr Staunton also pointed to Garda Pratt confirming that she never actually saw any alleged assault between the two men. 

He said that Sgt Doyle had a "legal entitlement" to respond with proportionate force if he was facing threats.

Judge O'Leary said he would hear the remaining evidence next month before arriving at a conclusion.

This will include evidence from Sgt Doyle and the Gsoc investigator for the case.
