A Judge struck out two cases in which he claimed that gardaí 'showed total disrespect' to the court.

The comments were made by Judge Desmond Zaidan on Thursday, July 6, at Naas District Court.

In the first case,, which was held in-camera (in private), a garda inspector was seeking an adjournment in the case.

However, the judge took issue with this, and said the inspector should have canvassed it earlier.

"He has shown disrespect to the court," he said: "No one outside of the presiding judge has the right to adjourn a case."

Judge Zaidan struck out the case without prejudice, and added: "The State should have had their ducks in a row, this was first brought before the court back in January, there is no excuse for it."

In the second case, which was also heard in-camera, a man was accused of two offences.

Defending barrister, Aisling Murphy, applied for a strike-out for both offences: she pointed out that, in relation to the first offence, the prosecuting garda was not present, and for the second, that while this case's prosecuting garda was present, the garda's witness (who is also a garda) was not present.

Again, Judge Zaidan told gardaí present in the courthouse that the gardaí should have canvassed this to the court earlier.

He added: "The trial for this case was fixed back in March. The gardaí are also showing the alleged injured party disrespect by not attending today."

Judge Zaidan also struck out this case, but noted that the case could be re-entered by gardaí at a later date.
